Rumer Willis and her ex, Derek Richard Thomas, are back in court, and this time Thomas is making the allegations.
In a new declaration filed in Los Angeles Superior Court on August 27, Thomas claims Willis has been deliberately making it difficult for him to see their 3-year-old daughter, Louetta, months after a judge awarded Willis primary physical custody.
The filing marks the latest escalation in a custody dispute that has played out in court documents for more than a year, and it comes with Thomas directly denying the drug use and safety allegations Willis previously raised against him in the same case.
According to the new court papers, obtained by People, Thomas alleges that Willis has “done everything in her power” to interfere with, block and frustrate his relationship with Louetta.
He is asking the court to leave the existing custody order in place rather than grant Willis’ request to vacate the June 9 ruling that gave her primary physical custody while the two continued to share joint legal custody.
Thomas also used the filing to push back hard against Willis’ earlier claims that he posed a danger to their daughter, calling those allegations misleading and denying that he has ever struggled with drug abuse.
Derek Richard Thomas Says Rumer Willis Is Disrupting Court-Ordered Visitation
Thomas’ declaration goes beyond simply denying Willis’ past claims. He alleges that Willis has actively disrupted his scheduled parenting time with Louetta, something that would directly violate the terms of the June custody order if proven true.
That order initially gave Thomas supervised visitation, with a plan for those visits to transition into unsupervised time and eventually overnight stays as the case progressed.
The court also instructed both parents to attend co-parenting counseling and to communicate primarily through a designated co-parenting app rather than directly with one another.
TMZ, which separately obtained portions of the filing, reported that Thomas described Willis’ allegations about his alleged drug use and his willingness to cooperate with the custody arrangement as materially false and misleading.
Thomas has maintained throughout the case that he wants the existing parenting plan followed as written, and his latest filing asks the court to keep the June order intact rather than reopen the custody terms at Willis’ request.
He has also pushed back on any suggestion that he has refused supervision during his visits with Louetta, framing the recent conflict as one where Willis, not him, has failed to abide by what the court ordered.
A judge has independently verified neither party’s claims in this round of filings, and the court has not yet ruled on Thomas’ latest request.
What is documented is that both sides have now accused each other, in sworn filings, of failing to follow the custody arrangement put in place in June, turning what was already a contentious case into one where each parent says the other is violating the agreement.
The Filing Follows Months Of Dueling Allegations Between The Former Couple
Thomas’ latest declaration is hard to understand without the allegations that preceded it. Willis and Thomas, who dated for roughly two years before splitting in August 2024, have been locked in an increasingly public custody dispute since Thomas first requested a formal custody order.
In her response to that request, Willis alleged a pattern of emotional abuse and controlling behavior on Thomas’ part, and raised concerns that his conduct could pose a risk to Louetta.
Thomas has consistently and strongly denied those claims, describing his and Willis’ relationship as unhealthy at times but rejecting any characterization involving domestic violence or coercive control.
Willis’ mother, Demi Moore, also weighed in during the early stages of the case, submitting her own filing describing Thomas’ behavior as aggressive.
According to court documents reported at the time, Moore alleged that Thomas “appears to want to dictate and control Rumer’s environment to his needs” and said his conduct “creates unnecessary stress and fear for Rumer to this day.”
Thomas’ attorney, Mike Kretzmer, responded publicly when the June custody ruling came down, telling People that his client was “very pleased with the interim determination by the court on the custody issues” and adding that Thomas “will try issues pertaining to custody of Louetta in court and will not distort matters by trying this case in the press.”
That June ruling ultimately gave Willis primary physical custody of Louetta while both parents retained joint legal custody, and it ordered a custody evaluation for both parents as the case continues.
That same order, currently in effect, is what Thomas is now asking the court to preserve, even as he accuses Willis of not following it.
Given the volume of competing claims on both sides, it is important to treat the allegations in Thomas’ newest filing as exactly that: allegations awaiting a court’s review, not facts about what has actually happened between the two parents since June.
Rumer Willis Recently Relocated To Nashville With Louetta Amid The Ongoing Case
The new filing also lands against the backdrop of a major life change for Willis. In mid-August, roughly two months after being awarded primary physical custody, Willis announced on Instagram that she and Louetta had moved from Idaho to Nashville, Tennessee, a cross-country move she described as a “leap of faith.”
Willis moved to Idaho from Los Angeles in early 2025 after her split from Thomas, settling near where her parents, Bruce Willis and Demi Moore, raised her and her sisters.
The Nashville move represents her second major relocation with Louetta in under two years.
Willis has been open on social media about the difficulty of balancing her career with single parenthood since her split from Thomas, at one point posting a tearful video describing how hard it can be “doing everything alone,” even while stressing that Louetta herself is never the source of that difficulty.
She has also spoken candidly about the moment she realized her relationship with Thomas could not continue, telling the podcast “The Inside Edit” that watching a close friend get married helped bring that realization into focus.
Those personal reflections have run parallel to the legal proceedings, which have continued largely through formal court filings rather than public statements from either parent.
With Thomas’ new declaration now before the court, the custody case appears to be entering another contested phase, this time centered on whether the June order’s visitation terms are being honored.
No hearing or ruling on Thomas’ request to maintain the existing custody arrangement has been reported, and it remains unclear when the court will address the competing claims.
What is clear is that more than a year after their split, Willis and Thomas remain in active litigation over how to raise their daughter, with each parent now formally accusing the other of undermining an arrangement that a judge only finalized this past June.
