Sean “Diddy” Combs May Be Headed Back to Court Over New Sexual Battery Allegations
Sean “Diddy” Combs is already serving time in federal prison, but his legal troubles may not be over. The Los Angeles County District Attorney’s office is now reviewing a new sexual battery case connected to the music mogul, according to D.A. spokesperson Venusse Dunn. If the D.A. finds sufficient evidence, Combs could be facing an entirely separate criminal trial on top of his existing federal conviction.
The case was brought forward by publicist Jonathan Hay, who filed a police report in September 2025 alleging that Combs sexually battered him on two separate occasions, once in 2020 and again in 2021.
Hay initially filed the report in Largo, Florida, his hometown, but the matter was later transferred to Los Angeles authorities, where the alleged incidents took place. LAPD detectives investigated the claims for several months before recently submitting the case to the D.A.’s office for a charging decision.
How the Allegations Are Connected to Biggie’s Legacy

Hay says he first came into contact with Combs while working on a remix project involving the late Christopher “Biggie Smalls” Wallace, in collaboration with Biggie’s son, CJ Wallace.
Combs, who was one of Biggie’s closest associates, a longtime mentor, and producer, would reportedly show up at times while Hay and CJ were working together. Biggie was killed in Los Angeles in March 1997, and Combs had remained close to his family in the years that followed.
According to the police report, the first alleged incident occurred in September 2020, when Hay claims he was alone in a room with Combs. Hay alleges Combs masturbated into one of Biggie’s shirts and then directed Hay to perform a sexual act on him. There are further claims that Combs then threw the soiled shirt at him.
The Second Alleged Incident, Nearly Six Months Later

The second alleged incident took place in March 2021, when Hay says he flew to Los Angeles to continue working on the CJ Wallace project. He claims he again found himself alone with Combs, who called him a “snitch” before allegedly forcing Hay to perform oral sex on him. These are the specific claims LAPD brought to the District Attorney after concluding their investigation into the matter.
Combs’ legal team had previously filed court documents seeking to have Hay’s allegations dismissed in a related civil context. His camp had not responded to requests for comment as of the time of publication.
Where Diddy’s Legal Case Currently Stands

Combs was convicted in federal court in July 2025 for violating the Mann Act, which prohibits the transportation of individuals across state lines for sexual purposes.
The jury acquitted him on separate charges of sex trafficking and racketeering, but the Mann Act conviction alone resulted in a significant sentence. He is currently serving a 50-month federal prison sentence following his October 2025 sentencing.
The possibility of a new state-level prosecution out of Los Angeles adds another layer of legal jeopardy for the once-celebrated music executive. Should the L.A. County D.A. decide to file charges, Combs would face a separate criminal proceeding entirely independent of his federal case.
That determination now rests with the District Attorney’s office, which will assess whether the evidence meets the threshold for moving forward.
